A form one student from a school in Nairobi has been charged with murder before the High Court in Mombasa.
Mohamed Bashir Mohamed, from Uhuru High School, was accused alongside MR Hamis Hassan Omar but they both denied the charges.
The charge sheet before Justice Martin Muya states that the offence was committed on the night of September 4, 2013 at Majengo Mapya in Likoni, Mombasa County.
Lawyer John Magiya who represented Omar asked the trial judge to release him on reasonable bond term to allow him continue with his studies.
“My lord, the accused is minor and a form one student at Uhuru High School.
CONFIRM HIS AGE
“He is 15 years old according to his school documents which I will produce in court to confirm his age,” added Mr Magiya.
State counsel Sarah Ogweno told the court that investigations into the case have been completed and she is not opposed to the application
Justice Muya ordered the prosecution to ensure probation report is prepared and produced in court regarding the age of the accused minor.
“The investigation is complete and we shall leave it to the court to verify whether the accused is a form one student,” he added.
The judge further ordered that the case be mentioned on Tuesday next week.
